Department of Justice Enters Legal Challenge to Stop California's Redistricting Plan
Federal authorities have entered the fray in a legal challenge brought forward by California Republicans, seeking to halt the California's recently passed electoral boundaries.
This court case, filed in a US district court, challenges the redistricting plan supported by Governor Gavin Newsom, which was created in response to a Republican-led gerrymander in Texas.
"The state's electoral map constitutes a blatant attempt to seize control that violates civil rights and undermines the democratic process," stated the US attorney general.
Democrats have expressed confidence that the redistricting plan will survive court challenges.
"These opponents were defeated in the election and they are likely to face defeat in the judicial system," commented a representative for the governor.
Constitutional Challenge
The lawsuit claims that California's map improperly used race as a factor to significantly advantage Hispanic voters in contravention of the US Constitution.
"Race cannot be used as a substitute to advance political interests, but that is precisely what the California General Assembly did with the redistricting measure," argued a senior official from the Civil Rights Division.
Political Context
The legal battle constitutes the most significant counterpunch by the Democratic party in the continuing redistricting war that started with Texas and has extended to various parts of the country.
Unlike other states, where Republican state legislatures have enacted gerrymanders, California's plan required voter approval, which it obtained with nearly 65% of the vote.
Wider Consequences
Democrats need to flip just a small number of Republican-held House seats to gain majority of the chamber in next year's midterm election.
The political group controlling the majority will shape the remaining period of the sitting president's term, determining whether a unified Republican Congress will continue to deliver its political program or face resistance, congressional probes and possible further challenges.
